1. Services Provided

We assist individuals and entities in locating and recovering surplus or overage funds that may be owed to them following a foreclosure or similar forced sale.

Our services typically include researching claims, preparing documentation, communicating with relevant government agencies, and submitting claims on your behalf.

2. Contingency Fee Basis

Our services are provided on a contingency fee basis.

This means:

  • You owe us nothing upfront.
  • We only receive a fee if we successfully recover funds on your behalf.
  • The contingency fee percentage and terms will be detailed in a separate written Agreement, which must be signed before services commence.

If no recovery is made, you owe us no compensation for our services.

3. Client Responsibilities

To facilitate your claim, you agree to:

  • Provide accurate, complete, and timely information.
  • Cooperate with us in submitting necessary documents and forms.
  • Sign any required affidavits, authorizations, or contracts necessary for processing your claim.
  • Agree not to circumvent our company's efforts by making a claim without our involvement,

Failure to cooperate may result in termination of services.

4. No Guarantee of Recovery

While we use our best efforts to recover funds, we cannot and do not guarantee:

  • That any surplus funds exist.
  • That we will be successful in recovering funds.
  • The amount or timing of any recovery.

Recoveries depend on government agency processes, documentation, deadlines, and other factors beyond our control.

5. Use of Personal Information

We collect and use your personal information as described in our Privacy Policy (linked).

You authorize us to share necessary personal information with government agencies and third parties (such as legal counsel, if applicable) for the purpose of processing your claim.

6. Termination

Either you or we may terminate the relationship at any time, in writing.

If termination occurs after funds have already been recovered or substantial services have been performed, our right to receive the contingency fee may survive termination as outlined in your signed agreement.

7. Limitation of Liability

  • Any indirect, incidental, special, consequential, or punitive damages.
